Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Dierend mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Hezarfen LLC ("Dierend," "we," "our," or "us"), the operator of the Dierend platform.

2. Eligibility

• You must be at least 13 years old to create an account.
• If you are under 18, you must obtain verifiable parental or guardian consent before your account is activated. During registration you must provide a parent or guardian's email address, and your account remains restricted until they approve it.
• You must provide an accurate date of birth. Misrepresenting your age is a violation of these Terms.
• By using the App, you represent that you meet these requirements and that all information you provide is accurate.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate, current, and complete information during registration.
• You must not create multiple accounts, impersonate others, or use misleading usernames.
• Notify us immediately at info@dierend.com if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Post false, misleading, or fraudulent content (including fake emergency reports)
• Harass, bully, threaten, or abuse other users
• Upload content that is illegal, harmful, obscene, or violates the rights of others
• Use the App for any commercial purpose not authorized by Dierend
• Attempt to gain unauthorized access to other accounts, systems, or data
• Interfere with or disrupt the App's functionality or infrastructure
• Scrape, crawl, or collect data from the App without written permission
• Misuse the emergency reporting system (false reports may result in permanent account termination)
• Engage in animal cruelty or promote harmful practices toward animals

Violation of these rules may result in content removal, account suspension, or permanent termination at our sole discretion.

5. User-Generated Content

5.1 Your Content

You retain ownership of content you post (photos, text, videos). By posting content on Dierend, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the App and for promotional purposes.

5.2 Content Standards

All content must comply with our Acceptable Use policy. We reserve the right to remove content that violates these Terms or is reported by other users.

5.3 Emergency and Missing-Pet Reports

Reports submitted through the App may be shared with local animal welfare organizations, veterinary services, and other users in the vicinity. You confirm that all information in such reports is truthful and accurate to the best of your knowledge.

Dierend's reporting and alert features are community tools and are not an emergency, veterinary, or law-enforcement service. We do not guarantee that any report will be seen or acted upon. In an emergency, contact local authorities or a veterinarian directly.

5.4 Reporting and Moderation

You can report content you believe violates these Terms using the in-app "Report" option available on posts. We review reports and may remove content or take action against accounts that violate our policies. We may also remove content or suspend accounts where necessary to comply with legal obligations.

6. Subscriptions and Payments

6.1 Free and Paid Tiers

Dierend offers a free tier (Paw Print) and paid subscription tiers with additional features. Individual tiers include Fetch and Alpha; business tiers include Business Starter and Pack Leader; and veterinary tiers include Vet Pro, Vet Duo, and Vet Team. Veterinary practices may also purchase additional veterinarian "seats." The features, limits, and prices for each tier are shown in the App at the time of purchase.

6.2 Billing

• Subscriptions and in-app purchases may be billed through the Apple App Store, Google Play, or our payment processor Stripe, depending on the purchase and your platform.
• For purchases billed by Apple or Google, payment is charged to your Apple ID or Google Play account at confirmation, and renewals are governed by the applicable store's rules.
• Subscriptions are auto-renewing and renew for the same period unless cancelled before the end of the current billing period.
• All prices are shown in euros (€) and are inclusive of applicable payment-processing fees and taxes. We do not add separate surcharges for paying by card.

6.3 Cancellation and Refunds

• You can cancel an auto-renewing subscription at any time. For store-billed subscriptions, cancel through your Apple ID or Google Play settings; for Stripe-billed subscriptions, cancel in the App.
• Cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. We do not provide refunds for partial billing periods except where required by law.
• One-time digital purchases (such as alert boosts, extra AI scans, and premium usernames) are delivered immediately and are non-refundable once delivered, except where required by law.
• EU/EEA consumers: Where you have a statutory right of withdrawal for digital content, you acknowledge that by purchasing and accessing digital content immediately, you request immediate performance and lose the 14-day withdrawal right once delivery has begun. Your other mandatory consumer rights are not affected.

6.4 Marketplace Fees and Payouts

For transactions between users and sellers on the platform, Dierend charges a service commission that is deducted from the seller's proceeds via Stripe Connect:

• Veterinary bookings: a platform commission of 3% + €0.30 per transaction; the veterinarian receives the remainder.
• Shop orders: a platform commission of 5% + €0.30 per transaction (reduced to 3% + €0.30 for Pack Leader sellers); the seller receives the remainder.

Sellers are responsible for their own tax obligations on their proceeds.

6.5 Shop Purchases

Physical product purchases through the Dierend Pet Shop are processed via Stripe and fulfilled by individual sellers (business owners). Shipping costs, applicable taxes, delivery times, and refund/return policies are set by each seller and shown at checkout. Returns are handled directly between you and the seller, subject to each seller's return window.

6.6 Vet Appointment Payments

Payments for veterinary appointments are processed via Stripe. Cancellation and refund policies for appointments are determined by the veterinary practice.

6.7 Price Changes

We may change subscription prices with reasonable advance notice. Existing subscribers will be notified before any price increase takes effect, and continued use after the change constitutes acceptance of the new price.

7. AI Features Disclaimer

Dierend's AI features (including the AI Health Scan and AI Pet Matcher) use artificial intelligence to provide informational assessments based on pet photos and details you provide. To deliver these features, pet photos and related details are sent to third-party AI providers (Google Gemini, Anthropic, and/or OpenAI, depending on your subscription tier and the feature). Important: AI features are for informational purposes only and are not a substitute for professional veterinary diagnosis, treatment, or advice. AI results may be inaccurate or incomplete. Always consult a qualified veterinarian for your pet's health concerns. Dierend is not liable for any decisions made based on AI results.

8. Business and Veterinary Accounts

• Business and veterinary accounts require admin verification before activation.
• Veterinarians must provide valid professional credentials and license information.
• Businesses must provide accurate business information and comply with local regulations.
• Dierend reserves the right to reject, suspend, or revoke business/veterinary accounts that do not meet our standards.
• Business owners are responsible for the accuracy of their product listings, pricing, and order fulfillment.

9. Intellectual Property

• The Dierend name, logo, design, and App features are owned by Hezarfen LLC and protected by intellectual property laws.
• You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
• User-generated content remains the property of the respective users, subject to the license granted in Section 5.

10. Limitation of Liability

To the maximum extent permitted by law:

• Dierend is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee that the App will be uninterrupted, error-free, or secure.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
• We are not liable for the actions, products, or services of third-party businesses or veterinarians on the platform.
• We are not responsible for the accuracy of user-generated content, including emergency reports.
• Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Dierend, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms.

12. Account Termination

• You may delete your account at any time from Settings > Delete Account.
• We may suspend or terminate your account for violations of these Terms.
• Upon termination, your data will be deleted in accordance with our Privacy Policy.
• Sections that by their nature should survive termination (liability, indemnification, governing law) will remain in effect.

13. Third-Party Services

The App integrates with third-party services, including Firebase (Google), Stripe, Apple App Store and Google Play billing, Google Maps and Places, Google Sign-In and Apple Sign-In, the AI providers Google Gemini, Anthropic, and OpenAI, Expo (push notifications), Resend (email), and Sentry (error diagnostics). Your use of these services is subject to their respective terms and privacy policies. Dierend is not responsible for the availability or conduct of third-party services.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Belgium.

For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you via in-app notification or email. Continued use of the App after changes constitutes acceptance of the updated Terms.
