DMCA & Copyright Policy

1. Our Position on Copyright

Dierend is operated by Hezarfen LLC. Dierend hosts content uploaded by its users — posts, photos, videos, stories, shop listings and profile images. We respect the intellectual property rights of others and expect our users to do the same.

We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"). It is our policy to remove or disable access to infringing material and, in appropriate circumstances, to terminate the accounts of users who are repeat infringers.

Notifications of claimed copyright infringement should be sent to our Designated Agent:

3. Filing a Notice of Infringement

To be effective under 17 U.S.C. § 512(c)(3), your written notice must include substantially all of the following:

• A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
• Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list of those works.
• Identification of the material you claim is infringing and that you want removed, with enough detail for us to locate it — the in-app link or profile URL, the username of the account that posted it, and the approximate date it was posted.
• Your contact details: name, mailing address, telephone number and email address.
• A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on the owner's behalf.

Incomplete notices delay removal, because we cannot act on material we cannot identify.

4. What Happens After We Receive a Notice

• We review the notice and, where it is substantially compliant, remove or disable access to the material expeditiously.
• We notify the user who posted the material and provide them with a copy of your notice, including your contact details. If you do not want your details passed on, do not file a notice.
• We inform that user of their right to submit a counter-notification.

5. Counter-Notification

If your content was removed and you believe that removal was a mistake or a misidentification, you may send a counter-notification to the Designated Agent above. Under 17 U.S.C. § 512(g)(3) it must include:

• Your physical or electronic signature.
• Identification of the material that was removed and the location where it appeared before removal.
• A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
• Your name, address and telephone number.
• A statement that you consent to the jurisdiction of the U.S. Federal District Court for the district in which your address is located (or, if your address is outside the United States, any judicial district in which Hezarfen LLC may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notification, we will forward it to the original complainant. Unless they notify us that they have filed a court action seeking to restrain the activity, we may restore the removed material in 10 to 14 business days.

6. Repeat Infringers

We maintain a record of copyright notices received against each account. Accounts that are the subject of repeated, substantiated infringement notices will be terminated. This policy is applied in appropriate circumstances and at our discretion, as required by 17 U.S.C. § 512(i).

7. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and legal fees. Do not file a notice for content you do not own the rights to, and consider whether the use is a fair use before filing.

8. Users Outside the United States

The DMCA is United States law. If you are in the European Union, the notice-and-action provisions of the Digital Services Act (Regulation (EU) 2022/2065) also apply to content reported on Dierend, and you may report illegal content — including copyright infringement — through the in-app reporting tools or to the address above. We handle those reports through the same review process described in section 4.

9. Reporting From Inside the App

You can also report content directly in the Dierend app: open the content, tap the … menu, and choose Report. For copyright claims, a formal written notice to the Designated Agent above is still required before we can remove material under the DMCA.
